Iowa Court Says 'I Do' To Same-Sex Marriage
Friday August 31, 2007
By ruling that same-sex couples can marry, the Iowa District Court of Polk County has recognize the true nature of its constitution: Equal protection and treatment under the law. The ruling also struck down the state law defining marriage as between one man and one woman.
Presiding Judge Robert Hanson wrote that the one man-one woman law, "constitutes the most intrusive means by the state to regulate marriage. This statute is an absolute prohibition on the ability of gay and lesbian individuals to marry a person of their choosing."
Civil rights advocacy organization, Faith in America, responded with the following statement: "The ruling by District Judge Robert Hanson in Des Moines yesterday is an important step forward for ensuring full and equal rights for all Americans, including gay, lesbian, bisexual and transgender citizens. A democracy is at its best and strongest when it stands up for the civil rights of all its citizens and protects itself from those who would use false and inappropriate arguments to deny any group of Americans their rights."
Does this mean gay and lesbian couples can get married in Iowa?
Not yet. The case has been advanced to the Iowa Supreme Court, where a final decision will be made.
Is there any opposition to the ruling?
Polk County Attorney John Sarcone has begun efforts to reverse Judge Robert Hanson's ruling. "We respectfully disagree with the court's decision, and we're going to ask for a stay," Sarcone told CNN.com.
