Same-Sex Adoption OK in Maine

Ann Courtney and Marilyn Kirby of Portland, Maine have been raising two siblings (a 10-year-old girl and her 6-year-old brother) for six years. Last year, they petitioned the Probate court to adopt the foster children, but were rejected because they are a lesbian couple. Courtney and Kirby then took the matter to the Maine Supreme Judicial Court. And on August 30, 2007 the high court ruled unanimously in their favor on grounds that prohibiting the adoption would be counter to Maine's Adoption Act.
Now, with the joint adoption, in case of the death of one or both of their adopted parents, the siblings qualify for benefits such as insurance, Social Security and family leave. The ruling also opens the door for other gay and lesbian couples to adopt children.
