Gay Asylum Case Denied

The asylum case of a Brazilian national legally married to a Massachusetts man has been denied after Attorney General Eric Holder and the Obama Administration failed to act on a Friday deadline.

Genesio Oliveira and 48-year-old husband Tim Coco have been separated since August 2007 when Oliveira's application for asylum and an appeal were rejected. Oliveira and Coco were legally married in Massachusetts in 2005.

In March of 2009, Senate Foreign Relations Committee Chairman John Kerry (D-MA) has asked the Obama Administration to grant asylum to Genesio Oliveira, urging that the couple's separation was a "humanitarian situation that deserves an appropriate focus."

The Justice Department has not made comment on why Attorney General Eric Holder let the deadline pass.
